Below are excerpts from a July 25, 2022, lawsuit against the Sky Ranch HOA. The HOA didn’t send notice to other homeowners.
The Sky Ranch HOA didn’t inform the homeowners of this lawsuit because of course they didn’t. It is in response to a lawsuit against the HOA. Excerpts from the complaint appear below.
Providing no detailed/itemized explanation, the HOA increased the monthly fees by $40 to $272.58
The image below is from a 2017 HOA financial statement. This level of detail has not been provided since then. The current budget released to homeowners lists operating expenses in four broad categories: Utilities, Land Maintenance, Common Area, and Administration. It may not be a coincidence that the HOA filed their doomed lawsuit against Lennar Homes in late 2017, and we haven’t seen a detailed financial statement since then. The HOA, despite promises to the contrary, has not provided the details of the settlement, nor the cost of the pool slide lawsuit that was botched by filing it too late. The cost of restoring neglected landscape, as ordered by the City, may also have played a part.
Security video shows a group of coyotes. One of them got a rat that was in the bushes.
Sky Ranch is one of the City Landscape Maintenance Districts. If the HOA fails to maintain the landscape, the City may levy assessments and do it. Wishing the HOA away is not a solution. Defunding the slopes was a failure to comply with the CC&Rs, and it risked the City taking charge. So far, the City has opted for persuasion and fines. The excerpt below is from a report in the tax section of the City Council agenda packet.
Irrigation below the beehives ran from at least 11:45 am to 1:15 pm, today, during the heat of the day. These same sprinklers were running yesterday, but that might have been part of a test because landscapers were present then.
